Alimony Basics

Temporary and, or, permanent alimony may be involved in any divorce. At the beginning of a divorce, temporary orders for child custody, visitation and support may be issued by a family court judge. These orders remain in place until the divorce is complete.

Permanent alimony can be mutually agreed to through negotiation or the mediation process, or it may be ordered by the court at the conclusion of a trial. Judges have a great deal of discretionary power in deciding this issue and consider a number of factors, including the length of the marriage, the relative earning capacity of each spouse, and fault.
