Most child support payments are determined by a formula established by state statute and related regulations. We enter the father's and the mother's income into a court-approved computer program, which computes the weekly child support payment.
It is important to consult an experienced attorney regarding child support to ensure that all sources of income and deductions are included for both parents. Our family law attorney, Tom Pettinicchi, will work to explore all sources of income, including payment for overtime hours, investment income, rental income and cash payments.
We can also petition the court to approve a deviation from the recommended child maintenance payments based on the unique circumstances of each case. The court may consider a deviation if the parents are sharing physical custody of the child, for example, based on the coordination of the total family support or where there are substantial visitation expenses for the non-custodial parent. .
If you or your former spouse has sustained a substantial change in circumstances that result in a significant loss or increase in income, please contact our law firm to discuss a modification of child support.
